Dual Controls And Passengers

So really if there is noting in the cars on dual controls and passengers in a 703 operation what is the problem??The only agencys that want the duals removed fron Bell 204/205/212/412 aircraf are certain provincal fire programs.

So it's back to the lawyers deciding what is legal and what is not. Like a lot of the CARS, it's about as clear as mud. It doesn't doesn't matter till something goes wrong.

I'm not sure how someone could claim a regulation that doesn't exist is not clear. If there is no regulation preventing it, it is not illegal.

 

Is it safer to remove them? Likely. Are there ways to mitigate the risk when they are installed? I think, yes.

Now, if your COM says that Dual controls must be removed (when essential persons or passengers are in the seat) and you choose to leave them in...then you are illegal and in violation to:

 

CARS 702.11 or CARs 703.14 depending on whether your doing aerial work or air taxi.

 

(1) An air operator shall ensure that all operations personnel are properly instructed about their duties and about the relationship of their duties to the operation as a whole.

 

(2) The operations personnel of an air operator shall follow the procedures specified in the air operators company operations manual in the performance of their duties.

 

That seems quite clear.

The one specific procedure that concerns some fire agencies is getting in and out of the helicopter front seat during hover deplane/emplane ops. With the duals in they are climbing over the collective while the pilot is flying.
